Please read these Terms of Service (“Terms”) carefully before using our website or services. By booking an appointment, using our website, or receiving services from Elevate Wellness Co. (“we”, “us”, or “our”), you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Services Provided
Elevate Wellness Co. is a chiropractic and wellness clinic located in Thornhill, Ontario, operated by Dr. Anita Raghubir, Doctor of Chiropractic. Our services include, but are not limited to:
Chiropractic assessment and manual therapy
1-on-1 Pre & Postpartum Coaching (in-person and digital)
C-Section Scar Release Therapy
Athletic Injury Rehabilitation
Custom Orthotics
Services are provided at our clinic or digitally where applicable, and are subject to the professional standards of the College of Chiropractors of Ontario.
2. Not a Substitute for Emergency Care
Our services are not a substitute for emergency medical care. If you are experiencing a medical emergency, please call 911 or proceed to the nearest emergency room immediately. The information on our website is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment.
3. Appointments and Cancellations
Booking:
Appointments may be booked online through Jane App, by phone, or by completing our website contact form. Bookings are subject to practitioner availability.
Cancellations and No-Shows:
We ask that you provide at least 24 hours’ notice if you need to cancel or reschedule your appointment. Late cancellations or missed appointments without adequate notice may be subject to a cancellation fee. We reserve the right to apply such fees at our discretion.
We reserve the right to reschedule or cancel appointments due to unforeseen circumstances and will notify you as promptly as possible.
4. Fees and Payment
Service fees are provided at the time of booking or upon request. Payment is due at the time of service unless a prior arrangement has been made. We accept payment by credit card, debit, and other methods as posted at the clinic.
We work with a number of insurance providers (including Canada Life, Manulife, Desjardins, and Alberta Blue Cross). It is your responsibility to understand your insurance coverage and any applicable deductibles or limits. We are not responsible for claims denied by your insurer.
5. Health Disclosure and Informed Consent
You agree to disclose all relevant health history and conditions at the time of assessment. Withholding relevant health information may affect the safety and effectiveness of your care. Prior to receiving treatment, you will be asked to provide informed consent as required by Ontario law and the standards of the College of Chiropractors of Ontario.
6. Digital and Remote Services
Where digital or hybrid coaching services are offered, these are intended as a supplement to or extension of in-person care where appropriate. Digital sessions are conducted using secure video platforms. Participation in digital services requires a reliable internet connection and appropriate device. We are not responsible for connectivity or technical issues on your end.
Digital services may not be appropriate for all conditions. Dr. Raghubir will advise you if in-person assessment is required.
7. Intellectual Property
All content on our website — including text, images, graphics, blog posts, and videos — is the property of Elevate Wellness Co. or its content licensors and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use our content without our express written permission.
8. User Conduct
When using our website or communicating with our clinic, you agree not to:
Provide false, misleading, or inaccurate information
Use our website in any way that is unlawful or harmful
Attempt to gain unauthorized access to our systems or records
Post or transmit harmful, offensive, or inappropriate content through any contact form or communication channel
9. Limitation of Liability
To the maximum extent permitted by applicable law, Elevate Wellness Co. and Dr. Anita Raghubir shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website, including but not limited to damages for personal injury, loss of data, or loss of income.
Our total liability to you for any claim arising from the use of our services shall not exceed the amount paid by you for the specific service giving rise to the claim.
Nothing in these Terms limits our liability where such limitation is not permitted by law, including in cases of gross negligence or professional misconduct.
10. Disclaimer of Warranties
Our website and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the website will be error-free, uninterrupted, or free of viruses or harmful components.
11. Third-Party Services
We use third-party platforms (such as Jane App for appointment booking) to deliver our services. Your use of those platforms is subject to their respective terms of service and privacy policies, which we encourage you to review. We are not responsible for the conduct, content, or policies of third-party services.
12. Privacy
Your personal and health information is governed by our Privacy Policy, available at https://elevatewellnessco.ca/privacy-policy/. By using our services, you consent to our collection and use of your information as described therein.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Ontario.
14. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on our website with a revised effective date. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
